1. Introduction

These Terms & Conditions (“Terms”) govern your use of Atello (“the Service”), operated by Serhii Anfilov (“we”, “us”, or “our”). Atello is a trading name of Serhii Anfilov. By accessing or using the Service, you agree to be bound by these Terms.

2. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms.

3. Eligibility & Acceptance

By using Atello, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

4. Subscription & Payments

Atello offers Free, Pro, and Studio subscription plans. Paid plans renew automatically until canceled. You may cancel at any time from your account settings. If you cancel, you retain access to paid features until the end of your current billing period. We reserve the right to change plan prices or features with reasonable notice.

5. Acceptable Use

You agree not to use the Service to:

• violate any applicable law or regulation;
• send spam, fraud, or misleading communications;
• infringe intellectual property rights or other proprietary rights;
• interfere with the security or availability of the Service, including malware, scraping, or probing;
• generate, distribute, or promote illegal, hateful, harassing, or harmful content.

6. Intellectual Property

Atello, its code, branding, documentation, and all non-user-generated materials remain the property of Serhii Anfilov. You are granted a limited, non-exclusive, non-transferable license to use the Service within your selected plan. You may not reverse engineer, redistribute, or resell the Service.

You retain ownership of any content you upload, generate, or edit using the Service. We do not claim ownership over your inputs or outputs. You are responsible for ensuring you have the rights to use any material you upload or generate.

7. AI-Generated Content

Atello includes generative AI features (e.g., AI image generation, cold email drafting, LinkedIn post generation, document assistance). Outputs may not always be accurate, complete, or appropriate for your intended use. You are solely responsible for reviewing, editing, and verifying any AI-generated content before using it commercially or publicly.

You must not use AI features to generate illegal content, deepfakes, hateful or discriminatory material, malware, or content that infringes third-party rights. We reserve the right to restrict outputs or suspend accounts for repeated misuse.

8. Content & Copyright Claims

If you believe content generated or uploaded through Atello infringes your intellectual property rights, contact us with the details of the claim and the affected content. We will review the claim and may remove or restrict content or accounts in cases of repeated infringement.

9. Service Level

We aim to provide a reliable and secure service, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may perform maintenance, updates, or suspend access as needed.

10. Termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, engage in fraud or security risks, or repeatedly violate our acceptable use policies. Upon termination, your license to use the Service ends, and we may delete or retain your data in accordance with our Privacy Notice.

11. Limitation of Liability

To the fullest extent permitted by law, Serhii Anfilov shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service. Our aggregate liability is limited to the total amount paid by you to Atello in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated by email or through the Service.
